1. Who we are and what this policy covers
This website is maintained by Telegraph Psychology Collective PC, which also does business as North Berkeley Counseling Collective, together with the affiliated, independently licensed clinicians listed on the website (together, “Telegraph,” “we,” “us,” or “our”). This policy explains how we collect, use, disclose, and retain personal information in connection with this website and related inquiries and communications, and how to contact us about your information.
Each affiliated clinician is an independently licensed professional who provides clinical services in their own practice and is responsible for the care they provide. Your intake and treatment documents identify your treating clinician and describe the clinical and financial arrangements for your care. This policy does not change those arrangements.
2. Health information and HIPAA notices
Your treating clinician provides a HIPAA Notice of Privacy Practices that describes how protected health information may be used and disclosed, the clinician’s responsibilities, and your rights. A HIPAA Notice is available through the HIPAA Notice link on this website, and a copy is available on request. Information submitted through a website inquiry or scheduling process may be protected health information depending on the circumstances; it is not excluded from healthcare privacy protections because it was submitted online.
When information is protected by HIPAA, the California Confidentiality of Medical Information Act, or another applicable healthcare privacy law, we handle it under those requirements and the applicable Notice of Privacy Practices. If this website policy conflicts with those protections, the applicable law and healthcare privacy notice govern. Using this website or accepting its terms is not a HIPAA authorization or consent to any disclosure that requires a separate authorization.
3. Information we collect
Information you provide. This may include your name, contact details, preferred method of contact, location, scheduling preferences, and anything you choose to include in an inquiry. If you ask for help finding a clinician or using insurance, we may receive information about your preferences, coverage, and requested services. If you book an appointment online, you do so on Square’s booking site, and the information you enter there is collected by Square (see Section 6). Information collected through clinical intake, treatment, and billing systems is also subject to the applicable healthcare privacy notice.
Technical information. Our website host and its security systems may process your IP address, browser and device information, the pages you request, referring pages, and the dates and times of access, as needed to deliver and protect the website. Section 6 describes cookies and third-party services. We may also receive information from a person acting on your behalf, or from a clinician, insurer, or service provider when permitted by law.
Please share only what we need. Provide only the information reasonably needed for your request. Please do not send detailed clinical information or documents through the website, ordinary email, or text message; once you begin care, your clinician will explain how to share that information securely. Public comments, reviews, and social media posts are visible according to the settings of the service where you post them, so avoid including information you want to keep private.
4. How we use information
We use information as reasonably necessary to respond to inquiries; help coordinate clinician selection and appointments; provide requested administrative support; communicate about services you request; maintain and secure the website; diagnose technical problems; prevent fraud or misuse; and comply with applicable legal requirements. Uses of protected health information for treatment, payment, and healthcare operations are addressed in the applicable HIPAA Notice of Privacy Practices.
If we offer optional educational or promotional emails and you choose to subscribe, we use your contact information to send them and manage your preferences. You can unsubscribe using the instructions in any message or by contacting us. Unsubscribing does not stop necessary administrative or treatment-related communications. We obtain any consent or authorization required for a particular communication or use of information.
5. When we disclose information
We disclose information to affiliated clinicians, personnel, and service providers who need it to carry out authorized functions, such as website hosting and security, communications, scheduling, clinical records administration, and billing. Access and disclosures are limited as required by applicable law. When a vendor acts as a business associate under HIPAA, an appropriate business associate agreement is in place before the vendor performs the covered activity. A vendor’s role and the information it handles determine which requirements apply.
We may disclose information to a clinician or other recipient to fulfill your request or with your permission; to professional advisers who help us with legal, accounting, or compliance matters; and when permitted or required by applicable law. We evaluate legal demands and apply any required authorization, privilege, notice, or other protections before releasing protected information. This paragraph does not by itself authorize the release of clinical records in response to a subpoena or other request.
A proposed or completed business reorganization or transfer may involve disclosure of information only as permitted by applicable law and subject to appropriate confidentiality protections. Protected health information remains subject to applicable healthcare privacy requirements. We may use or disclose information that has been properly de-identified under the legal standard that applies to it.
6. Cookies, third-party services, and Do Not Track
No analytics or advertising tracking. We do not use website analytics tools, advertising pixels, or other technologies to track your activity on our website. The fonts, images, and other files that make up our pages are served from our own website rather than from third-party font or content networks.
Google Search Console. We use Google Search Console to understand how our public pages appear and perform in Google Search. We verify ownership through a DNS record or a static verification tag or file; verification does not install Google Analytics or any visitor-tracking script. Search Console provides search-performance and indexing reports; we do not submit inquiry forms, clinical records, or other patient information to it.
Online booking (Square). We partner with Square (Block, Inc.) for online booking. Our Book Online page links to an appointment booking page hosted by Square. When you select “Book on Square,” you leave our website and go to Square’s site, which Square operates. Square receives the information you enter to book, such as your name, contact details, and the appointment you choose, along with technical information such as your IP address and browser details. Square’s site may use its own cookies, analytics, and other tracking technologies, and Square’s own privacy notice applies to its site. Please don’t include health information or the reason you are seeking therapy when you book; your clinician will discuss that with you directly. You can avoid the online booking page by calling or emailing us instead.
Do Not Track and Global Privacy Control. Because we do not track visitors over time or across third-party websites, our website does not operate differently in response to a browser “Do Not Track” or Global Privacy Control signal. Our own pages do not allow third parties to collect personally identifiable information about your online activities over time and across different websites. Square’s booking site, described above, is a separate site operated by Square under its own privacy practices.
No sale or targeted advertising. We do not sell your personal information or share it for cross-context behavioral advertising or targeted advertising, and we do not otherwise share it except as described in Section 5.
Browser settings may let you restrict cookies, although doing so can affect how third-party sites, such as Square’s booking page, work. Cookie preferences do not replace a legally required authorization for disclosure of protected health information, and we do not treat acceptance of a cookie banner or website terms as such an authorization.
7. Retention and security
We keep personal information for as long as reasonably necessary for the purpose for which it was collected, taking into account the nature of the information, our relationship with you, applicable retention requirements, and legitimate dispute-resolution or compliance needs. Clinical and billing records are subject to separate retention requirements. A request to delete a website inquiry does not necessarily require deletion of a clinical record or other information that must be retained.
We use administrative, technical, and physical safeguards appropriate to the information and applicable legal requirements. No transmission or storage system can be guaranteed completely secure. This statement does not waive our duties to protect information or your legal rights. Where a breach requires notification, we provide notice as required by applicable law.
8. Your choices and requests
You may contact us to ask about personal information we maintain, request correction, request deletion where applicable, or update your communication preferences. We may need to verify your identity and authority before acting, and we will explain any limitations that apply, including legal retention duties. Please do not send identity documents or sensitive clinical information by ordinary email unless we have arranged a secure method.
Rights concerning medical records, confidential communications, restrictions, amendments, and other protected health information are described in the applicable HIPAA Notice of Privacy Practices. Additional privacy rights may apply depending on your location, the information involved, and whether the relevant law applies to our activities. We respond to requests within the time required by applicable law and do not retaliate against anyone for exercising protected privacy rights.
9. Children and adolescents
Our public website provides general information and is not directed to children under 13. It is not intended to collect information directly from children under 13 through public website features. If you believe a child under 13 has submitted information through those features, please contact us so we can assess and address it as required by law.
Clinical services for children and adolescents are governed by separate intake, consent, confidentiality, and recordkeeping requirements. This website policy does not prohibit lawful treatment of minors, require destruction of records that must be retained, or give a parent access to information that applicable law protects from parental disclosure. Consent and access rights are determined under the law that applies to the care.
10. External services and policy changes
Links may take you to a scheduling service or another independently operated website. Please review the privacy notice that applies to that service. A link does not eliminate our responsibilities for vendors acting on our behalf or for information otherwise subject to our legal obligations.
We may update this policy to reflect changes in our practices or legal requirements. We will post the revised policy with its effective date and provide additional notice or obtain consent when required. A revision does not retroactively authorize a use or disclosure that requires separate consent or authorization.
