Effective date: October 27, 2026
1. Scope and acceptance
These Terms of Use govern access to and use of the public website maintained by Telegraph Psychology Collective PC, which also does business as North Berkeley Counseling Collective, together with the affiliated, independently licensed clinicians listed on the website (together, “Telegraph,” “we,” “us,” or “our”). By using the website, you agree to these terms to the extent an enforceable agreement is formed under applicable law. If you do not agree, please do not use the website. Visiting the website does not waive your statutory rights.
These terms concern website use. They do not replace clinical informed consent, telehealth consent, financial agreements, HIPAA Notices of Privacy Practices, or agreements with a treating clinician. If a separate agreement governs a particular clinical service, that agreement governs the service in the event of a conflict with these website terms, subject to applicable law. Our Privacy Policy explains how we handle personal information.
2. Information and clinical relationships
The website describes available services and affiliated clinicians and provides general educational information. Educational content is not individualized assessment, diagnosis, treatment, or professional advice. Do not delay seeking appropriate care because of something you read on the website.
Browsing the website, reading content, submitting an inquiry, or requesting an appointment does not by itself establish a clinician–patient relationship or guarantee acceptance for treatment. Clinical services begin through the treating clinician’s acceptance and intake process or as otherwise established under applicable law. Once a treatment relationship exists, nothing in these terms diminishes the duties arising from it.
Affiliated clinicians are independently licensed professionals who exercise their own professional judgment within their scope of practice and are responsible for the clinical services they provide. Your intake and treatment documents identify your treating clinician and explain the relevant clinical, administrative, and financial arrangements. Nothing in these terms limits any responsibility that the law places on Telegraph Psychology Collective PC or on any clinician.
3. Emergencies and communications
The website and routine inquiry channels are not emergency services and are not continuously monitored. If you are experiencing an immediate medical or psychiatric emergency, call 911 or go to the nearest emergency department. If you are in crisis or thinking about suicide, call or text 988 to reach the Suicide & Crisis Lifeline, available 24 hours a day. Established patients should also follow any emergency arrangements discussed with their treating clinician.
Please provide accurate contact information and tell us your communication preferences. Ordinary email and text messages may involve privacy risks, so please do not send sensitive clinical information that way; your clinician will explain how to share it securely. Providing a phone number or making an inquiry does not, by itself, constitute consent to automated promotional text messages. Any marketing enrollment is handled separately with the disclosures and consent required by law.
4. Availability and location of care
Clinician availability, appointment times, specialties, and service locations may change. A listing does not guarantee that a clinician is accepting new patients or that a particular treatment is appropriate for you. Clinical services may be provided only where the treating clinician is legally authorized to practice and the service is otherwise permitted. Tell your clinician where you are physically located for each telehealth appointment, including when traveling.
5. Fees, insurance, and appointments
Fees, cancellation policies, payment responsibilities, and other financial terms are provided through the applicable financial agreement and required notices. These website terms do not create a blanket no-refunds rule or replace rights under insurance contracts or applicable law.
Information about insurance participation, eligibility, benefits, or estimated cost is provided for planning and is not a guarantee that an insurer will pay a claim. Coverage can depend on the specific clinician, plan, service, location, authorization, deductible, and other plan terms. Billing questions and corrections are addressed under the applicable agreements and law. Nothing here authorizes billing prohibited by a payer contract or law, or eliminates any right to a required Good Faith Estimate or billing dispute process (see our No Surprises Act notice).
6. Permitted use and intellectual property
You may view the website and download or print reasonable portions of publicly available educational content, including worksheets, for your personal, noncommercial use, keeping copyright and attribution notices intact. Additional permissions may accompany particular resources. Ownership remains with Telegraph or the applicable rights holder. Other copying, distribution, commercial reuse, or modification requires permission unless applicable law permits it.
Do not use the website unlawfully; impersonate another person; submit information you are not authorized to provide; interfere with website operation; bypass access controls; introduce malicious code; or attempt to obtain another person’s private information. Do not use automated means to extract nonpublic or personal information. These restrictions do not limit uses protected by applicable law.
7. Third-party links and website operation
Links to third-party resources are provided for convenience or information and are not a guarantee of their accuracy or suitability. Independently operated services, including our online scheduling provider, may have separate terms. We remain responsible for duties imposed on us by law, including duties associated with vendors acting on our behalf.
We make reasonable efforts to keep website information useful and current, but errors, interruptions, and outdated information may occur. We may correct content, modify features, or restrict misuse. Suspending website access does not itself end an established treatment relationship or eliminate obligations concerning continuity of care, records, or notice.
8. Website disclaimers and limits
To the extent permitted by law, the public website and its general educational materials are provided as available, without a guarantee of uninterrupted access or a particular result. Treatment outcomes vary. These statements apply to public website content and operation and are not a waiver of the professional standard of care.
Nothing in these terms excludes or limits liability for professional negligence, fraud, willful misconduct, gross negligence, unlawful disclosure of information, or any liability that cannot lawfully be excluded or limited. These terms do not impose a dollar cap on clinical claims or require you to indemnify Telegraph for its own conduct.
9. Accessibility
We want the website to be usable by everyone. If you have trouble accessing any content, please see our Accessibility Statement or contact us and we will help.
10. Governing law, changes, and contact
California law governs these website terms except where applicable federal law or mandatory protections of another jurisdiction control. These terms do not require arbitration, waive class proceedings, or restrict any right to complain to a regulator or licensing board. If a provision is unenforceable, the remaining provisions apply to the extent permitted by law.
We will post revised terms with an updated effective date and give additional notice or seek assent when required. Revisions do not retroactively eliminate accrued rights. Questions:
